WHAT YOU NEED TO KNOW


For those of you who are unsure about recent changes proposed by Nillumbik Shire Council, we hope this following ‘simple’ explanation may help. 

Council has two proposed Planning Scheme Amendments that it is about to vote on: 

C81 – Significant Landscape Overlays – Applying 7 new ‘Character Areas’ to the rural parts of the Nillumbik Green Wedge. 

C101 – Environmental Significance Overlays – Identifying and assessing the biodiversity value of land within the rural areas of the Nillumbik Green Wedge (a review of the existing ESOs).

Amendment C81 has already been reviewed by an Independent Planning Panel, which has already released its report and recommendations.

The decision on whether to adopt Amendment C81 is going before council on Tuesday 24th May at 7.00pm.

Amendment C101 was originally ‘abandoned’ by Council on the 13 April at its Special Policy & Services Meeting. Council officers sought “legal advice” to clarify the committee’s powers to make such a decision. It was confirmed that to give legal effect to the decision to abandon Amendment C101, it needed to be ratified by council at the 26 April Ordinary Council Meeting. At that meeting, a motion (Cr Klein) to ratify the earlier decision was debated and lost. A subsequent motion (Cr Young) requesting that the Minister for Planning appoint a Planning Panel to hear C101, allowing for a 3 month period where any submitter can request an ecologist to conduct a site visit to review the environmental significance of their property, was debated and won. However, with a motion of rescission being moved on the same night, this matter will have to be debated again at the 24 May Ordinary Council Meeting.

We’re a group of very passionate landowners who are not willing to stand by and let the Council tell us what to do with our properties – properties we have been looking after very well for over a hundred years!


We encourage residents who have not as yet made a submission to council on C101 to do so. The majority of properties are proposed to have an ESO placed over them, but if you have any bush, substantial trees or a creek/tributary on your property, it is more than likely that you will have at least one of the four possible overlays.

If these amendments are passed you may

NOT be able to put up fences without a permit.
NOT be able to keep animals (cats, dogs and horses included)
NOT be able to collect firewood or clean up your property
NOT be able to get insurance due to higher risk of bushfire.
BE at increased risk of bushfire
BE made to fence off dams and creeks.
BE at the mercy of council for everything you do on your property.

AND MOST IMPORTANTLY
YOUR PROPERTY VALUE WILL BE DESTROYED!!!!

It’s vital as many residents as possible attend the next Council Meeting at 7.00pm on Tuesday 24th May at the Shire Offices to hear the council debate and see for yourselves the discussion around both Amendment C81 and C101.

We want councillors to ABANDON both C81 and C101 and then consult with the landowners and community COMPREHENSIVELY to achieve a negotiated outcome.
